1. Agreement and Acceptance

These Terms and Conditions govern tutoring and related educational services provided by Tutor With Joshua ("Tutor With Joshua," "Tutor," "I," "me," or "my") to the purchaser, parent, guardian, or student receiving services ("Client").

By purchasing a tutoring session or package, scheduling or attending a session, submitting payment, or otherwise accepting services from Tutor With Joshua, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.

2. Services

Tutor With Joshua provides educational tutoring and related academic support, including mathematics, science, test preparation, study skills, organization, academic coaching, and other educational services offered through the Tutor With Joshua website or agreed to separately.

Services may be provided online, in person, or through another mutually agreed format. The specific subject matter, frequency, format, and goals of tutoring may be adjusted based on the student's needs.

3. No Guarantee of Academic Results

Tutor With Joshua will provide educational services in good faith and with reasonable professional care. However, no particular academic result is guaranteed.

Tutor With Joshua does not guarantee any particular grade, passing a course, any specific test or examination score, admission to a school, college, program, or institution, improvement by a particular amount, completion of academic work by a particular deadline, or any other specific educational outcome.

Student success depends on numerous factors outside the Tutor's control, including attendance, effort, practice, completion of assignments, prior knowledge, school requirements, and individual learning needs.

4. Academic Integrity

Tutor With Joshua provides instruction, guidance, explanations, practice, feedback, and academic support. Tutor With Joshua will not knowingly complete examinations, quizzes, graded assignments, projects, essays, or other academic work on behalf of a student when doing so would violate the policies of the student's school, college, testing organization, or other institution.

The Client and student are responsible for complying with all applicable academic-integrity requirements.

5. Scheduling

Tutoring sessions are scheduled for a specific date, time, duration, and format. A session is considered reserved once the appointment has been confirmed and any required payment has been received.

Sessions begin and end at the scheduled times unless otherwise agreed. Availability is not guaranteed until an appointment has been confirmed.

6. Client Lateness

If the Client or student arrives late to a tutoring session, the session will normally still end at its originally scheduled time. Time lost because of Client or student lateness is not refundable and will not normally be added to the end of the session.

If Tutor With Joshua is responsible for a significant delay, the Tutor may extend the session, reschedule the affected time, provide a credit, or provide another reasonable remedy.

7. Cancellation and Rescheduling Policy

Tutor With Joshua requires at least 24 hours' notice to cancel or reschedule a tutoring session without charge.

A session cancelled or rescheduled with less than 24 hours' notice is considered a late cancellation and may be charged in full. If the Client is using a prepaid tutoring package, one session may be deducted from the package for a late cancellation.

This policy exists because appointment time is reserved specifically for the Client and may not reasonably be filled by another student on short notice. Tutor With Joshua may make exceptions for genuine emergencies, severe illness, unsafe travel conditions, or other extraordinary circumstances at the Tutor's discretion. An exception made on one occasion does not waive this policy for future sessions.

8. No-Shows

A Client who fails to attend a scheduled appointment without providing notice is considered a no-show. No-show sessions are charged in full. For prepaid packages, the missed session will ordinarily be deducted from the remaining package balance.

9. Repeated Late Cancellations or No-Shows

Three late cancellations, no-shows, or any combination of the two may result in suspension or termination of future tutoring services. Tutor With Joshua may require prepayment or impose additional scheduling restrictions before accepting future appointments from a Client with repeated attendance issues.

Any sessions already completed, missed, or subject to the late-cancellation policy remain earned and non-refundable. Unused prepaid sessions are handled according to the refund provisions below and are not automatically forfeited solely because future services are terminated.

10. Single-Session Purchases

Payment for a single tutoring session reserves a specific block of professional time. Once the tutoring session has been completed, the payment is fully earned and non-refundable.

A properly cancelled session may be rescheduled or refunded where appropriate. A late cancellation or no-show may be charged in full under these Terms.

11. Prepaid Tutoring Packages

Tutor With Joshua may offer prepaid packages containing multiple tutoring sessions. Package pricing may reflect a discount compared with the standard single-session rate.

A package session is considered used when the session has been completed, been missed as a no-show, or been charged under the late-cancellation policy. Used sessions are non-refundable.

12. Five-Session Package Refunds

Five-session packages are generally non-refundable after the first tutoring session has been used.

If no sessions have been used, Tutor With Joshua may approve cancellation and a refund, less any disclosed and legally permissible payment-processing costs actually incurred.

If Tutor With Joshua becomes unable to provide the purchased services, the Client will receive an appropriate refund or credit for services that were paid for but not provided.

13. Ten- and Twenty-Session Package Refunds

A Client may request cancellation of the unused portion of a ten-session or twenty-session package within 15 calendar days of the original purchase date.

If the request qualifies under this policy, the Client may receive a refund equal to 50% of the amount attributable to eligible unused sessions. Sessions already completed, missed, or charged as late cancellations are not considered unused.

After 15 calendar days from purchase, unused package sessions are generally non-refundable except where Tutor With Joshua is unable to provide the purchased services, Tutor With Joshua agrees otherwise in writing, or a refund is required by applicable law.

Nothing in this section limits a mandatory cancellation or refund right provided by law.

14. Discounted Package Pricing

Prepaid packages may be sold at a discounted per-session rate in exchange for the Client's advance commitment to multiple sessions.

If Tutor With Joshua allows an early cancellation or refund of a discounted package, sessions already used may, where disclosed at the time of purchase and permitted by law, be recalculated using the applicable standard single-session or smaller-package rate in effect when the package was purchased. Any remaining eligible refund will then be calculated after accounting for the value of services already provided or charged.

15. Package Expiration

Unless otherwise stated at the time of purchase, prepaid tutoring packages expire 12 months after the date of purchase.

Unused sessions remaining after the expiration date may expire without refund, except where prohibited by law or where Tutor With Joshua agrees otherwise in writing. Any applicable expiration period should be reviewed by the Client before purchasing a package.

16. Inclement Weather and Unsafe Travel

If weather, road conditions, government advisories, emergencies, school closures, or other circumstances make travel unsafe or impractical, Tutor With Joshua may convert the session to online tutoring, reschedule the session, or arrange another reasonable alternative with the Client.

Tutor With Joshua will not require in-person attendance when the Tutor reasonably determines that travel presents a safety risk.

If the Client chooses not to attend because of weather and a reasonable online or rescheduling option is available, the normal cancellation policy may apply if that alternative is declined.

17. Online Tutoring and Technology

Clients receiving online tutoring are responsible for maintaining a reasonably functioning internet connection, compatible device, and any software reasonably required for the session.

If a session is materially interrupted because of a technical issue attributable to Tutor With Joshua, the Tutor may extend the session, reschedule the affected portion, provide a credit, or provide another reasonable remedy.

Technical problems caused by the Client's device, internet connection, software, or failure to join the appointment do not automatically entitle the Client to a refund.

18. Payment

Payment is due according to the price and payment schedule displayed at booking or stated on an invoice. Tutor With Joshua may require payment in full before confirming an appointment or package purchase.

Prices are subject to change for future purchases. A price change will not retroactively change the cost of a package already purchased unless the Client agrees otherwise.

19. Payment Processing Fees

Where permitted by law and applicable payment-network rules, Tutor With Joshua may charge or pass through payment-processing costs associated with electronic payments. Any such charge will be disclosed before payment is completed.

Payment-processing fees that have already been incurred may be non-refundable to the extent permitted by law.

20. Travel Fees

In-person tutoring may be subject to additional travel charges based on distance, travel time, location, or other relevant factors. Any required travel charge will be disclosed before the appointment is confirmed.

If an in-person session is converted to an online session before the Tutor travels, a fee attributable solely to that trip will not normally be charged.

21. Cancellation by Tutor With Joshua

If Tutor With Joshua must cancel a scheduled appointment, the Client will not lose the value of that tutoring session. The affected session will, as appropriate, be rescheduled, credited, replaced with equivalent tutoring time, or refunded.

22. Student and Client Conduct

Tutor With Joshua may refuse, suspend, or terminate services where a Client, student, household member, or other participant engages in harassment, threats, abusive behavior, discrimination, unsafe conduct, illegal activity, deliberate damage to property, repeated significant disruption, or other conduct that makes it unreasonable or unsafe to continue providing tutoring.

A session ended because of serious misconduct may still be considered completed and charged. Serious or repeated conduct issues may result in termination of future services.

23. Minors

When services are provided to a person under 18 years of age, the parent or legal guardian purchasing or authorizing the services is responsible for payment and compliance with these Terms.

Parents or guardians are responsible for providing any supervision, transportation, technology, permissions, or other arrangements reasonably necessary for the tutoring session.

24. Educational Materials

Clients may provide homework, assignments, study guides, class notes, testing materials, worksheets, or other educational documents for use during tutoring. Tutor With Joshua may use such materials for legitimate tutoring purposes.

Clients are responsible for retaining their own copies of important educational materials. Tutor With Joshua does not guarantee indefinite storage or retention of Client-provided materials.

25. Tutor-Created Materials and Intellectual Property

Worksheets, study guides, instructional materials, graphics, practice questions, explanations, lesson materials, and other original content created by Tutor With Joshua remain the property of Tutor With Joshua unless expressly stated otherwise.

Clients may use such materials for their own personal educational purposes. They may not reproduce, resell, publish, publicly distribute, or commercially exploit Tutor With Joshua materials without written permission.

26. Confidentiality and Privacy

Tutor With Joshua will make reasonable efforts to protect Client information.

Client information may be shared where reasonably necessary to process payments, schedule appointments, provide tutoring services, operate the Tutor With Joshua website, comply with legal obligations, or protect the rights or safety of Tutor With Joshua, the Client, or another person.

27. Communications

By providing an email address, telephone number, or other contact information, the Client authorizes Tutor With Joshua to communicate regarding appointments, scheduling, payment, services, and other matters relating to the tutoring relationship.

Marketing communications will be handled separately where required by applicable law.

28. Chargebacks and Payment Disputes

Clients are encouraged to contact Tutor With Joshua directly regarding billing concerns before initiating a chargeback or payment dispute. A Client remains responsible for amounts validly owed under these Terms.

If a charge is disputed, Tutor With Joshua may provide the payment processor, card issuer, bank, or other relevant institution with appropriate documentation, including booking records, payment records, correspondence, proof of acceptance of these Terms, attendance information, cancellation records, and evidence of services provided.

Nothing in this section waives any lawful right a Client has to dispute a payment.

29. Limitation of Responsibility

Tutor With Joshua will provide tutoring services with reasonable care. To the fullest extent permitted by law, Tutor With Joshua is not responsible for indirect, incidental, or consequential losses resulting from academic grades, examination performance, school or university decisions, disciplinary actions, missed educational opportunities, changes in school curriculum, actions of third parties, or circumstances outside Tutor With Joshua's reasonable control.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

30. Circumstances Beyond Reasonable Control

Tutor With Joshua is not responsible for delay or failure to provide services caused by circumstances reasonably outside the Tutor's control, including severe weather, natural disasters, widespread internet or utility outages, government orders, emergencies, illness, transportation disruption, civil emergencies, or other comparable events.

Reasonable efforts will be made to reschedule or provide an alternative format where practical.

31. In-Home and Off-Premises Purchases

Maryland law provides special cancellation rights for certain qualifying transactions entered into away from a seller's regular place of business. Where a transaction qualifies for a statutory cancellation right, that right applies regardless of any inconsistent provision in these Terms. Tutor With Joshua will provide any notice of cancellation required by applicable law when required.

32. Automatic Renewals

Unless explicitly disclosed at the time of purchase, tutoring sessions and prepaid tutoring packages do not automatically renew.

If Tutor With Joshua offers an automatic-renewal or recurring-payment arrangement in the future, the renewal terms, price, frequency, cancellation procedure, and other legally required disclosures will be provided before enrollment.

33. Compliance With Applicable Law

Nothing in these Terms is intended to waive any consumer right or legal protection that cannot lawfully be waived. Where Maryland or federal law requires a different cancellation period, refund, disclosure, remedy, or other consumer protection, the applicable legal requirement controls.

34. Governing Law

These Terms and the services provided by Tutor With Joshua are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.

35. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will remain in effect.

36. No Waiver

Tutor With Joshua's decision not to enforce a provision on one occasion does not waive the right to enforce that provision in the future.

37. Changes to These Terms

Tutor With Joshua may revise these Terms from time to time. Changes will generally apply prospectively. Material changes will not retroactively alter the financial terms of an already-purchased tutoring package unless the Client agrees, the change benefits the Client, or applicable law requires the change.

38. Entire Agreement and Contact

These Terms, together with the specific service description, price, package terms, invoice, booking confirmation, and any written agreement between Tutor With Joshua and the Client, constitute the agreement concerning the tutoring services purchased.

If a separately signed written agreement expressly conflicts with these Terms, the separately signed agreement controls to the extent of that conflict.
